Findings: Alleged Victim (AV) relies on the facility for his/her care. AV and Witness 1 (W1) have a history of aggressive verbal and physical behaviors toward each other. On or about May 25, 2022, AV was sitting on a bench that is between AV’s and W1’s rooms. W1 walked out of his/her room, picked up his/her walker and went straight to AV. AV and W1 were then involved in a resident-to-resident altercation. When W1 was next to AV, he/she pushed W1 away. As a result, AV sustained scratches and W1 sustained a goose egg bum on the back of their head. The facility has not updated the care plans for both AV and W1 to clearly reflect their known behaviors. The facility failed to care plan, which is a violation of resident rights, is neglect of care and constitutes abuse.
