Findings: Alleged Victim (AV) is known to wander around the unit and reach for items belonging to other residents, particularly food. Witness 1 (W1) is sensitive to someone trying to touch his/her food. On or about September 30, 2022, W1 slapped and kicked AV after AV reached for W1’s plate of food at lunch. There were similar incidents involving AV’s wandering and reaching for and touching food and other items on or about August 28th and September 3, 2022. TPS written after these two incidents only indicated to keep AV way from others, but it did not have interventions around AV’s known behaviors. The facility failed to properly care plan, which is a violation of resident rights, is neglect of care and constitutes abuse.
