Findings: Alleged Victim (AV) relies on the facility for his/her care. On or about October 4, 2022, AV sat down at the table with Witness 6 (W6). AV spilled his/her food and W6 started to yell at AV. AV got up and left the table, eventually AV came back to the table and W6 started yelling at AV again and then smacked AV on the hand. AV’s hand was immediately discolored with a red color and changed to purple color later. After AV was hit, he/she yelled “Ow, that hurt”, and pulled his/her hand away. The facility failed to provide a safe environment for AV, which is a violation of resident rights, is neglect of care and constitutes abuse.
