Findings: Alleged Victim (AV) relies on the facility for his/her care. AV has an unpredictable sleep scheduled and was often up late in the night and early morning hours, and due to his/her diagnoses would loudly express his/her confusions and needs for support. On or about October 13, 2022, while staff were working with another resident, AV called out for assistance while in the common area of the home. Witness 1 (W1) walked up to AV and hit AV with an open hand. On or about October 22, 2022, AV was self-ambulated close to another resident and due to confusion and AV’s vocalization being loud, the resident hit AV in the legs with a cane. The facility failed to provide a safe environment for AV, which is a violation of resident rights, is neglect of care and constitutes abuse.
