Findings: Witness 2 (W2) has a known history of behaviors. Alleged Victim (AV) is known to have a history of invading peoples’ personal space and believes that he/she is an employee at the facility. AV’s assistance to other residents is not always welcomed by residents. On or about March 22, 2023, W2 slapped AV”s arm for invading W2’s personal space. On or about April 5, 2023, AV would not allow W2 to leave W2’s room. When AV bent down to speak to W2, W2 grabbed AV by the neck and pushed AV back. There were no additional interventions added to AV’s care plan after the event between AV and W2 on April 5, 2023. The facility failed to care plan appropriately due to AV’s known behaviors, which is a violation of resident rights, is neglect of care and constitutes abuse.
