Findings: The Alleged Victim (AV) and Witness 1 (W1) have history of behaviors and resident-to-resident altercations. W1 is care planned for staff to be aware of surroundings of W1 and known to have sudden verbal and physical outbursts, including numerous episodes in June, July, and August 2023. According to an investigation, on or about September 12, 2023, staff heard a commotion in a common area and found W1 with his/her hands around AV’s neck, choking AV from behind. AV experienced unreasonable discomfort, and a loss of personal dignity. The facility failed to provide a safe environment for AV which is a violation of resident rights, is neglect of care which constitutes abuse.
