Findings: The Alleged Victim (AV) and Witness 1 (W1) rely on the facility for his/her care. AV is care planned to have their apartment door locked when AV is in bed. W1 has a history of resident-to-resident altercations and is care planned to be redirected with one-to-one conversation from staff when wandering into other residents’ rooms and when showing agitation. According to an investigation, on or about November 25, 2024, W1 entered AV's room and was observed placing a pillow over AV's face. W1 physically assaulted AV resulting in AV crying and being visibly upset. The facility failed to follow AV's care plan when AV's door was left open and the facility failed to properly address W1's behaviors when interventions were not developed or implemented to effectively address agitated behaviors, which is a violation of resident’s rights, is neglect of care and constitutes abuse.
