Findings: The Alleged Victim (AV) is dependent on the facility for both care and a safe living environment. AV voluntarily offered jewelry from their personal collection to Alleged Perpetrator #2 (AP2), who accepted the gift. AP2 had not been provided with the facility’s policies regarding the acceptance of gifts from residents. An investigation was conducted into the allegation that AP2 failed to protect AV from theft, and the investigation determined AP2 was not substantiated. The facility failed to ensure AP2 received and understood company policy related to resident gift-giving, resulting in the loss of AV’s personal property. The facility’s failure to provide AP2 with the appropriate policy constitutes a violation of the resident’s rights, is considered neglect of care, and constitutes abuse.
