Findings: Alleged Victim (AV) relies on the facility for his/her care needs. On or about June 14, 2025, Alleged Perpetrator 2 (AP2) contacted Witness 1 (W1) to ask if AP2 could attend an appointment at 7:30 in the breakroom. AP2 had not given anyone advanced notice of this appointment. It was agreed that AP2 could do so as long as AP2 did not leave the break room and keep a walkie on AP2. AP2 failed to follow the agreement with W1 and instead left the building entirely. AP2 said that AP2 had W1's permission to leave for a doctor's appointment. AP2 did not tell anyone before leaving the building. Prior to the appointment AP2 was supposed to check and change all the residents in AP2's section. AP2 failed to do so. As a result, AV had not been changed, and AV’s brief was wet and leaking. AP2 failed to provide service to AV, which is neglect of care and constitutes abuse. Respondent failed to assure AV received the needed service around incontinence, to ensure the safety of AV. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
