Findings: The Alleged Victim (AV) resides in the memory care, has a history of wandering behavior and is dependent on staff for daily care needs. AV's care plan instructs staff to ensure AV stays out of other resident's rooms. Witness 1 (W1) has a history of sexual behaviors towards AV and other residents. According to the investigation, on or about November 5, 2025, W1 came out of their room asking for staff to help remove AV who was in his/her apartment. AV was found seated in a chair in AV's room. Staff had documented AV wandering into other resident's room prior to the incident. This placed AV at risk of serious harm due to W1's history of recent sexualized behaviors. The facility failed to protect AV from potential harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
