- Findings
- The Alleged Victim (AV) and Witness 1 (W1) reside in the Respondent’s facility and rely on facility staff for assistance with daily needs and safety. W1 has a documented history of engaging in physical altercations and entering other residents’ rooms without permission. Between December 24, 2025, and February 17, 2026, staff observed W1 attempt to enter another resident’s room 36 times and physically enter another resident’s room 11 times. Facility staff interventions when W1 was wandering or attempting to enter other residents’ rooms included providing W1 with an individual activity in a supervised area, maintaining visual supervision, distracting or redirecting W1, accompanying W1 during walking, providing toileting assistance, and offering coffee, snacks, or individual activities in a supervised space. On or about February 14, 2026, AV was seated outside AV’s room when W1 entered the room. AV followed W1 inside and instructed W1 to leave. W1 then grabbed AV, pushed AV against the door, and punched AV in the abdomen, causing pain, visible marks on AV’s shoulders, and discoloration to AV’s abdomen. The Respondent failed to provide adequate supervision and did not follow W1’s service plan. This constitutes abuse by neglect as defined in OAR 411-020-0002(1)(b)(A)(i).
